Bankruptcy, is it right for you?

Bankruptcy no longer carries the stigma it used to. A recent article in MSN Money said "Bankruptcy once regarded as a shameful and humiliating failure, has become an everyday fact of life: More Americans filed for bankruptcy last year in the United States than in the entire decade of the 1960s." The article went on to say Getting credit after a Chapter 7 liquidation filing, once a trial, is now easy for many bankrupts. Mortgage loans are available as little as six months after bankruptcy, while many debtors report getting new credit cards before their case is even completed."

Bankruptcy is intended to be a last alternative. other options include: consolidation loans to reduce high interest payments and allow for easier repayment terms. Consolidation doesn't help, however, if the source of the problem is too little income for too much debt.

There are three methods of filing bankruptcy!

The safest method is to hire an experienced lawyer to handle everything for you. This is the easiest and safest way because you have a professional with you every step of the way. The Next Best Method is the Attorney Assisted Bankruptcy.This is the most economical to file bankruptcy. This is hybrid method that the Smith Law Firm decided initiate in response to the current economic turmoil. More and more people are out of work, working for less wages and experiencing higher costs and frankly just don't have the funds to file bankruptcy. The law firm decided to start offering an Attorney Assisted Bankruptcy Plan. We know that because of the financial pressures and lack of of funds more and more people are trying to file bankruptcy on their own. This is known as Pro Se filing. The United States Bankruptcy court tells us that 81% of bankruptcy cases that were dismissed were filed by debtors who did not have an attorney. This is a fixed flat fee program to evaluate your case, educate you in the rules of law and prepare your paperwork. He will make sure everything is in order then after you review and sign your petition the Law Firm will file the petition for you. After that you will attend the meeting of the creditors and act as you own attorney. Since the law firm has prepared and filed the petition we would not anticipate any problems. If any problem should occur you can retain the law firm to handle that issue.

The Third Method is to do it your self or Pro Se This method is the cheapest up front but can prove very costly You can obtain the forms for free from the bankruptcy court and fill them out, file and represent yourself. The clerks of the court and not allowed to give you any legal advice including telling you whether the forms are correctly filled out. The Bankruptcy Trustees are lawyers but are not representing you, They are representing the bankruptcy court and making sure your creditors are treated fairly. Remember The United States Bankruptcy court tells us that 81% of bankruptcy cases that were dismissed were filed by debtors who did not have an attorney. Having your case dismissed puts you right back where you started and could have other costly consequences. Some people have lost their property and lost the ability to file again for up to 6 months.
